What you are buying.
One event, one price, nothing that renews. Your photographs stay yours, the album is yours to open or keep shut, and everything is kept for a year.

What this is
Night Knows gives the guests at one event timed prompts to photograph, record and answer, and compiles what comes back into one album with a short film. You buy one event at a time.
It is sold by Beyza Karpuzcu Teoman, a sole proprietor in Brooklyn, New York.
Using it means agreeing to this page and to the privacy policy.
What you pay
A one-time price for one event, shown on the pricing page before you buy. Nothing renews, there is no subscription, and your guests are never charged for anything.
The price is set by how many guests may join. Photographs are not limited: the band governs how many people can take part, not how much they send.
Prices change from time to time. An event is sold at the price shown when it was bought, and a later change never alters what you already paid.
When the band is full
Guests who try to join after the band is full are turned away and you are told. Anybody already inside carries on as normal — nobody is cut off mid-evening.
You can move to a larger band while the night is running and pay only the difference between what you have already paid and the larger band.
The windows
Guests may keep uploading for ten days after the event begins. After that the event is closed and nothing further can be added.
Everything is kept for one year from the date you bought the event. At the end of that year the media and everything built from it are removed. Download what you want to keep before then — the album offers everything as one file.
What we ask of you
Tell your guests that the evening is being photographed this way. They are being asked for pictures and recordings, and the only person who can tell them that is the person who invited them.
You are responsible for what is sent to your event. Do not use this to collect material from people who have not agreed to take part, and do not use it for anything unlawful.
You control your album: you decide whether its link opens for anybody, and you can hide or remove anything in it.
What we do and do not promise
We will run the service with reasonable care, and we will not look at your photographs except where we have to in order to fix something you have asked us to fix.
We cannot promise that every guest's phone, network or browser will behave on the night, and we do not promise uninterrupted service. This is a supplement to a photographer, not a replacement for one — if a moment matters to you more than anything else, have somebody paid to be pointing at it.
Nothing here limits any right you have as a consumer that cannot be limited by agreement.
What we can owe you
If we are ever liable to you for anything connected with an event, the most we can owe is the amount you paid for that event. We are not liable for indirect or consequential losses.
This does not limit liability for anything the law does not allow to be limited, and it does not take away any right you have as a consumer where you live.
The reason to say this plainly: the price of a night is a small number and what it holds is not replaceable. That gap is why this clause exists, and it is also why the whole of the rest of this product is built the way it is — a guest already inside is never cut off, an upload window stays open for ten days, and everything is downloadable as one file for a year. A refund is the worst outcome we can offer you, so the work goes into not needing one.
Who owns what
Your photographs, recordings and words are yours and your guests'. We do not claim ownership of them and we do not use them to advertise anything.
We hold them only to run the service for you — to build your album, your compositions and your film, and to show them to the people you have opened them to.
If we ever want to show an example of a real evening anywhere, we will ask that host first and take no for an answer.
Refunds
If something on our side stops your event working, write to us and we will refund it. If you bought the wrong band or changed your mind before the event has opened its doors, write to us and we will refund it.
Once an evening has run and its album has been built, the thing you bought has been delivered.
A refund takes back what it paid for. The guest limit returns to the one your remaining payment covers, which may be none of them, and the event stops admitting people beyond it. Nothing already taken is deleted — the photographs, the album and the film stay where they are.
Ending it
You can delete an event at any time, which removes its media and everything built from it.
We may close an account that is being used to collect material from people who have not agreed to it, or for anything unlawful. If we do, we will say why.
What may not be sent
An event is yours to run, and these are the few things that are never part of that: material that is unlawful, sexual images of anybody, images of children other than by their own parent or guardian, anything that harasses or threatens a person, and anything you do not have the right to send.
Do not use an event to gather pictures of people who have not been told the evening is being photographed this way. The guest list is yours and so is that conversation.
A host can hide or remove anything in their own album, and a guest can remove what they sent. If something here is reported to us we may remove it and, where it is serious, close the event and say why. Material that appears to show the sexual exploitation of a child is reported to the authorities.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules, and any dispute will be heard in the state or federal courts sitting in New York County, New York.
If you are a consumer somewhere else, this does not take away the protections of the law where you live — those apply whatever this page says.
Changes to these terms
If these change in a way that matters, the date at the top changes and hosts with an active event are told by email. An event already bought keeps the terms it was bought under.
